City Council Minutes 07/06/2010

Tuesday evening, July 6, 2010.  Regular Meeting of the City Council held in the Council Chambers, City Hall.~ Meeting called to order by Council President Neil Janssens at 7:30 o’clock p.m.


Any person may make a video or audio recording of an open session of a meeting, or may transmit the meeting through any medium, subject to reasonable requirements of the chair as to the number, placement and operation of equipment used so as not to interfere with the conduct of the meeting.~ Any person intending to make such recording shall notify the Chair forthwith.  All Documents and exhibits used or referenced at the meeting must be submitted in duplicate to the City Clerk, as they become part of the Meeting Minutes.

Steve Marcotte, Staff Reporter for The Gardner News, identified himself and announced he planned to audio record the meeting.  President Janssens informed the Council, where no objections were raised as to the manner and/or location of recording.

Roll call taken – Ten (10) members present, Councillors Alice Anderson, Henry Ares, Joshua Cormier, Ronald Cormier, Patrick Gerry, Edward Gravel, Scott Graves, James Minns, James Robinson, Jr. and President Neil Janssens; one (1) absent, Councillor David Boudreau.

The Opening Prayer was recited in unison.

The Pledge of Allegiance was recited in unison.

OATH OF OFFICE

President Janssens declared a brief recess to allow Councillor James Robinson, Jr. to be administered the Oath of Office by the City Clerk, in accordance with the provisions of Section 23 of the City Charter, requiring the Oath be administered before the City Council. (Councillor Robinson was administered the Oath of Office by the City Clerk in the Clerk’s Office on June 1, 2010).

That “An Ordinance Limiting the Scope of Operation of Hawkers and Peddlers (Ordinance No. 31) and amended several times thereafter, be further amended by inserting the following:

SECTION1A.  Sunday, September 27, 2010 is hereby exempt from the prohibition against Sunday peddlers in recognition of the City of Gardner’s 225th Anniversary Celebration.

Councillor Joshua Cormier, Chairman of the Public Safety Committee, explained the Committee has been working on a revised Junk Dealer Ordinance, the draft of which is modeled on the Town of Barnstable’s Bylaw.

Councillor James Minns, Chairman of the Public Service Committee, reported the Committee desires to move ahead and accept the statute, as well as to file the home rule petition seeking to place the question before Gardner voters on the November 2, 2010 State Election ballot.  As it stands, the City no longer can plow unaccepted ways without accepting the statute.  Councillor James Robinson stated that even if the voters accept the Statute, the City can still refuse to plow private ways.  Councillor Joshua Cormier added that the list of unaccepted ways included in the Council packet isn’t the ‘end-all” list.

On a motion by Councillor James Minns, seconded by Councillor Henry Ares, it was voted on voice vote, nine (9) yeas, Councillors Alice Anderson, Henry Ares, Joshua Cormier, Ronald Cormier, Patrick Gerry, Scott Graves, James Minns, James Robinson, Jr. and President Neil Janssens; one (1) nay, Councillor Edward Gravel; one (1) absent, Councillor David Boudreau, to accept the provisions of Massachusetts General Law, Chapter 40, Section 6C, Removal of Ice and Snow from Private Ways and to direct the following question be placed on the official ballot for the election of officers at such city election, in accordance with the provisions of Massachusetts General Law, Chapter 40, Section 6D:

A PETITION FOR AN ACT AUTHORIZING THE PLACEMENT OF A CERTAIN QUESTION ON THE BALLOT TO BE USED AT THE 2010 BIENNIAL STATE ELECTION IN THE CITY OF GARDNER

To petition the General Court to the end that legislation be adopted precisely as follows.~ The General Court may make clerical or editorial changes of form only to the bill, unless the Mayor and City Council approve amendments to the bill before enactment by the General Court.~ The Mayor and City Council are hereby authorized to approve amendments which shall be within the scope of the general public objectives of this petition.~

Whereas, The deferred operation of this act would tend to defeat its purpose, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

AN ACT AUTHORIZING THE PLACEMENT OF A CERTAIN QUESTION ON THE BALLOT TO BE USED AT THE 2010 BIENNIAL STATE ELECTION IN THE CITY OF GARDNER.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION~1.~~Notwithstanding the provisions of section 6D of chapter 40 of the General Laws as to the time and manner of voting on the question, the state secretary shall cause to be placed on the official ballot to be used in the city of Gardner at the biennial state election to be held in the year 2010 the following question:

Shall the city of Gardner vote to accept the provisions of section six C of chapter forty of the General Laws, which authorize cities and towns to appropriate money for the removal of snow and ice from private ways therein open to public use?

SECTION 2.  If a majority of the votes in answer to said question is in the affirmative, then said section shall thereupon take full effect in such city or town, but not otherwise.

SECTION 3.  This act shall take effect upon passage.

FINANCE COMMITTEE

Councillor Alice Anderson, speaking for the Finance Committee, stated the Finance Committee is in favor of the proposed changes to the Finance Committee’s charges as historically have been under the Committee’s jurisdiction, including “Budget” and “Information Technology”, which now falls under the Treasurer’s Office.  She added that the Annual budget would still be referred to the Council as Committee of the Whole.  On a question from Councillor Joshua Cormier, Councillor Anderson stated the other Standing Committees would still receive budget reports for departments under their charge.

On a motion by Councillor Alice Anderson, seconded by Councillor Ronald Cormier, on recommendation of the Finance Committee, it was voted on voice vote, nine (9) yeas, Councillors Alice Anderson, Henry Ares, Joshua Cormier, Ronald Cormier, Patrick Gerry, Edward Gravel, James Minns, James Robinson, Jr. and President Neil Janssens; one (1) nay, Councillor Scott Graves; one (1) absent, Councillor David Boudreau to amend Council Rule No. 13.4 Committee on Finance, by inserting “Appointments & Vacancies”, “Budget”, and “Information Technology”, and amending “Tax Collector” and “Treasurer” to read “City Collector/Treasurer”; “Registrars” to read “Registrars of Voters”, and “Purchasing/Parking” to read “Purchasing & Civil Code Enforcement”; and by deleting~“Mary E. Kane Building”.

On a motion by Councillor Ronald Cormier, seconded by Councillor Edward Gravel, it was voted on voice vote, ten (10) yeas, Councillors Alice Anderson, Henry Ares, Joshua Cormier, Ronald Cormier, Patrick Gerry, Edward Gravel, Scott Graves, James Minns, James Robinson, Jr. and President Neil Janssens; one (1) absent, Councillor David Boudreau, to “Recognize Arielle Maddocks of Gardner, a 2010 Honors Graduate of Montachusett Regional Vocational Technical School, for achieving the Gold Medal in the Job Skill Demonstration Open Competition at the 2010 SkillsUSA National Championship Competition held in Kansas City, Missouri from June 22 to June 25”.  

Councillors Ronald Cormier and Edward Gravel presented Ms. Maddocks with a Recognition Certificate.  Councillor Gravel read aloud comments about Ms. Maddock’s award (attached), and Councillor Ronald Cormier commented on the excellent educational institution that is Monty Tech.

On a motion by Councillor Ronald Cormier, seconded by Councillor Joshua Cormier, it was voted on voice vote, ten (10) yeas, Councillors Alice Anderson, Henry Ares, Joshua Cormier, Ronald Cormier, Patrick Gerry, Edward Gravel, Scott Graves, James Minns, James Robinson, Jr. and President Neil Janssens; one (1) absent, Councillor David Boudreau, to “Recognize Gail Landy as she enters into retirement~after serving the City of Gardner for over twenty-three years as Director of the Levi Heywood Memorial Library.~Gail’s leadership was instrumental in the successful operation of the library and which saw incredible growth in its use. The new library serves as a living testimonial to her efforts and leadership, and without her efforts, it would not have been possible to create this marvelous institution”.

CITY COUNCIL CHAMBERS AIR CONDITIONING
Councillor James Minns commented on the first use of air conditioning in the Council Chambers in his twenty years on the Council and thanked the persons responsible.
SUMMER CONCERT SERIES
Councillor Henry Ares announced the Summer Concert Series begins on Saturday night at 6:00 p.m. at Monument Park and acknowledged the great job the Committee has done and continues to do for the concerts.

GREENWOOD MEMORIAL POOL
Councillor James Robinson commented on the enjoyable morning he had swimming at Greenwood Memorial Pool, adding that lifeguards are now on duty and swim lessons are available.  

YOUTH COMMISSION-SPONSORED “MOVIES IN THE PARK”
Councillor Joshua Cormier announced the Youth Commission-sponsored “Movies in the Park” begin on Friday and are free and open to the public.

HEAT WAVE/NEIGHBORLY ADVICE
Councillor Joshua Cormier encouraged those who have elderly neighbors to check in on them during the heat wave.
GARDNER 225TH ANNIVERSARY CELEBRATION EVENTS
President Neil Janssens extended his thanks and appreciation to the 225th Anniversary Committee for the tremendous job in putting together the events of the past weekend, including the fireworks and concert.  He cited the work of Scott Huntoon and Chuck LaHaye, and noted the outstanding efforts of Jennifer Griest, the Mayor’s Secretary.
