Monday evening, January 4, 2010. Regular Meeting of the City Council held in the Council Chambers, City Hall.~ Meeting called to order by City Clerk Alan L. Agnelli at 7:30 o’clock p.m.
Roll call taken – Ten members present, one unsworn (Councillor-Elect James Robinson, Jr.).
In accordance with Section 5 of the Charter of the City of Gardner, the City Clerk announced nominations were in order for election of a Council President for the year 2010.
Councillor David T. Boudreau nominated Councillor Joshua L. Cormier for Council President.
Councillor Ronald F. Cormier nominated Councillor Neil W. Janssens for Council President.
On a motion by Councillor James Minns, seconded by Councillor Alice Anderson, it was unanimously voted on voice vote (Councillor-Elect Robinson absent) to close nominations.

On a motion by Councillor Joshua Cormier, seconded by Councillor Alice Anderson, it was unanimously voted on voice vote (Councillor-Elect Robinson absent) to accept the Minutes of the Informal Meeting and Regular Meeting of December 21, 2009, as written.

AN ORDINANCE AMENDING AN ORDINANCE RELATIVE TO LICENSES AND PERMITS OF DELINQUENT TAXPAYERS UNDER THE AUTHORITY OF SECTION 57 OF CHAPTER 40 OF THE GENERAL LAWS OF MASSACHUSETTS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GARDNER AS FOLLOWS:
That “An Ordinance Relative To Licenses and Permits of Delinquent Taxpayer Accounts Under the Authority of Section 57 of Chapter 40 of the General Laws of Massachusetts (Compilation of Ordinance No. 139) adopted by the City Council and several times amended be further amended as follows:
By striking “SECTION 5.” and inserting the following:
SECTION 5.
The Mayor may waive such denial, suspension or revocation if he/she finds there is no direct or indirect business interest by the property owner, its officers or stockholders, if any, or members of his immediate family, as defined in section one of chapter two hundred and sixty-eight A in the business or activity conducted in or on said property.
By striking “SECTION 6.” and inserting the following:

President Neil Janssens announced a Joint Session of the City Council and School Committee would be scheduled for Tuesday, February 16, 2010 to appoint a Representative to the Montachusett Regional Vocations Technical School Committee (time to be determined). The President directed the School Committee be notified, and that the Personnel Director place a Vacancy Announcement on the City’s Website, as well as in The Gardner News. Letters of Interest would be received by the Personnel Department, assembled and transmitted to the City Clerk for delivery to the City Council and School Committee.

On a motion by Councillor Alice Anderson, seconded by Councillor Henry Ares, it was unanimously voted on voice vote (Councillor-Elect Robinson absent) to grant renewal of a Class II Motor Vehicle Dealers Licenses to Brian K. Michaud, d/b/a Brian’s Auto Sales, 549 West Broadway, said license expiring December 31, 2010.

On a motion by Councillor Ronald Cormier, seconded by Councillor James Minns, it was unanimously voted on voice vote (Councillor-Elect Robinson absent) to grant the Mayor permission to fill a Police Sergeant Vacancy, said vacancy due to the resignation of Sergeant Leonard Crossman.

On a motion by Councillor Ronald Cormier, seconded by Councillor Joshua Cormier, it was unanimously voted on voice vote (Councillor-Elect Robinson absent) to grant the Fire Chief permission to fill a Firefighter position in the Fire Department. The position is funded through a one-year grant from the Commonwealth of Massachusetts.
NEW BUSINESS
On a motion by Councillor Joshua Cormier, seconded by Councillor Alice Anderson, it was unanimously voted on a voice vote (Councillor-Elect Robinson absent) to consider New Business.
On a motion by Councillor Henry Ares, seconded by Joshua Cormier, it was unanimously voted on a voice vote (Councillor-Elect Robinson absent) to send a letter of appreciation to Elm Street School for hosting the 2010 City Inaugural Exercises.
On a motion by Councillor J. Cormier, seconded by Councillor Anderson, it was voted (Councillor-Elect Robinson absent) to adjourn at 7:59 o’clock p.m. after recitation of the Closing Prayer.
